At Mali Krog, we believe sharing toys should be based on trust, care and common sense. Children play, toys get used, and normal signs of use are part of a toy’s life.
Our aim is not to penalise families for ordinary play. It is to keep toys safe, complete and enjoyable for the next child.
1. The trust deposit
A refundable trust deposit of €30 is required for membership.
The deposit is separate from the monthly membership fee and provides limited security for eligible outstanding amounts where permitted by law. It is not automatically used to cover damage, missing pieces or late-return fees while membership remains active.
When membership ends, any lawful and eligible outstanding amounts may be deducted in accordance with these Terms. The remaining balance will be returned within [insert refund period] using [insert refund method].
We will provide an explanation of any proposed deduction.
2. Normal wear and tear
Toys are made to be played with.
Small scratches, fading, minor cosmetic marks and other reasonable signs of normal use are not charged to members.
We assess each toy in the context of its age, materials, condition before rental and intended use.
The condition of a toy and any known visible signs of previous use should be recorded before it is rented.
3. Damaged toys
If a toy is returned damaged, we assess the situation individually and fairly.
We distinguish between normal wear and tear, accidental damage and significant damage resulting from clear misuse or improper handling.
Where a charge is justified, it will reflect the reasonable cost of repair or replacement, taking the toy’s condition, age and second-hand market value into account.
Compensation will never exceed the toy’s second-hand market value.
We will explain the evidence supporting the assessment and how the proposed amount was calculated.
4. Missing pieces and accessories
We understand that small pieces can sometimes go missing during play.
If a piece is missing, we first assess whether it is essential to the toy’s function or materially affects its safe use.
Where possible, we will try to replace the missing piece before considering a charge for the whole toy.
A charge may apply if the missing piece is essential, affects safety or significantly prevents the toy from being used as intended.
Any charge will be proportionate and will never exceed the toy’s second-hand market value.
5. Late returns
The standard rental period is 30 calendar days.
A late-return fee of one-seventh (1/7) of the rental price applies for each working day of delay. Weekends are excluded from the calculation.
For example, if a toy is due on a Thursday and is returned on the following Monday, Friday counts as one working day of delay; Saturday and Sunday do not count.
The rental price used to calculate the fee is the price of that specific rental, as shown in the catalogue or booking confirmation.
The final Rental Terms will specify how public holidays are treated, whether a grace period applies and whether a maximum fee applies.
Please contact us as soon as possible if you need more time.
6. How charges are handled
If a charge applies, we will explain what happened, why the charge is being made and how the amount was calculated.
Eligible charges may include significant damage caused by clear misuse, qualifying missing pieces or late returns.
Charges can be paid separately by card or another published payment method. Alternatively, an equivalent amount may be deducted from a future subscription in TOYkens, but only with your explicit consent and where legally permissible.
We will not automatically convert a charge into a TOYken deduction without your agreement.
7. Questions and disputes
If you disagree with a proposed charge, please contact us at [Business email].
We will review the circumstances, consider any evidence you provide and explain our decision.
We aim to resolve concerns fairly, transparently and with common sense.
8. Unpaid charges
If a charge remains unpaid for more than 14 days after its due date, Mali Krog may consider cancelling membership for breach of the Terms, subject to applicable law.
Before taking this step, we will notify the member and provide an opportunity to resolve the outstanding amount or raise a dispute.
If membership is cancelled, eligible outstanding amounts may be deducted from the trust deposit where permitted by law. Any remaining balance will be returned.
Our promise
We want families to feel comfortable sharing toys.
We will treat every situation individually, distinguish ordinary play from significant damage and communicate openly.
The goal is to keep toys in circulation—not to punish children for playing.
